Definitions

Xpert Find ("us", "we", "our" and "ours") means Xpert Find Limited, registered in England No. 6905201 at 15 Jedburgh Street, London, SW11 5QA

• " Tradesman" or "Tradesmen" means any business or person who registers on the Website or affiliate tradesmen who work in conjuction with Xpertfind in order to quote for work posted by Customers
• "Customer" or "Customers" means any person who submits or publishes a job on the Website for Tradesmen to quote on
• "You" means anyone making use of the Xpert Find Services
• "Users" means any Tradesman or Tradesmen and/or Customer(s)
• "Website" means the collective set of website used to access Xpert Finds services as described in the overview below, and all the pages, content and sub-domains contained therein
• "Job" means a project that a Customer wants to commission via a Tradesman

Governing Law & Jurisdiction

Terms and Conditions shall be governed by and construed in accordance with English law and subject to the exclusive jurisdiction of the English courts.

Overview

Xpert Find provides an online marketplace to enable Tradesmen to find high quality Jobs from Customers who are in need of trade services. Our mission is to bring Tradesmen and Customers together in a fair and transparent manner, providing ease and convenience to the Users of our Website.

Limitation of liability

Choosing a Job, negotiating or entering into a contract with a Customer are acts of sole discretion by the Tradesman. As such, You agree to not hold Xpert Find liable for any agreement between You and another User.

Xpert Find makes every reasonable attempt to ensure that information provided on the Website is correct and accurate. However, we cannot guarantee the accuracy of the information on this Website, and are not liable for any problems or losses arising from errors or omissions in the content.

You acknowledge that Xpert Find may not examine your use of the Website or the nature of the information you are sending or uploading, such as your job skills, testimonials and other business specific listings. Xpert Find therefore excludes all liability of any kind for the transmission or reception of such information of whatever nature.

E-mails and other communications that are generated from information provided by Customers and Tradesmen are not under the editorial control of Xpert Find. Xpert Find is not responsible and cannot be held liable for any inaccuracies, or any other form of damaging words, sentences, pictographic content or statements contained in the components of E-mails that are not under Xpert Finds direct editorial content.  

Xpert Find does not endorse or approve any Customer registered on the site and it is the sole discretion of the Tradesman to choose a Customer Job. Although we do not endorse the Customer, we ensure that the Customer has a valid registration with us including details such as phone number and email address.

Tradesmen agree not to hold Xpert Find responsible for any damages or other liabilities arising from Work performed for any Customer chosen as a result of using the services provided by Xpert Find. Xpert Find cannot be involved in Tradesmens dealings with Customers, or control whether or not Customers will honour any terms of any contract that may have been set up as a result of using Xpert Finds services

You agree that Xpert Find shall not be liable for any losses or damages whatsoever arising from or in any way connected with this contract, including, without limitation, loss of profits to business arising from delays or loss of information.

Xpert Find cannot and does not guarantee and does not warrant against human and/or machine errors, omissions, delays, interruptions or losses of information or data, infringing any material, or defamation.

Xpert Find cannot guarantee the exact time of response to any E-mail, telephone or written enquiries or Website form submissions. As such, you agree not to hold Xpert Find responsible for any damage arising as a consequence. Any responses made by Xpert Find do not purport to be complete and exhaustive.

Without limiting the foregoing, Xpert Find shall have no liability for failures, delays or damages arising from any of the following a) acts of nature such as fire, flood, earthquakes b) governmental or other intervention such as acts of war, strikes, material shortages, transportation c) broadcasting failures due to interruption of services such as telephone lines, server delays, power supply. You agree not to hold Xpert Find responsible for any external factors beyond the control of Xpert Find that may affect its production or delivery of the Website and any information incorporated in it or any of its obligations under this Agreement.

Disclaimer

Xpert Find ensures validity of the customer registration before posting a Customer Job. However, as we are reliant on Customer to specify their Job requirements, we make no guarantee regarding the accuracy of the information provided. Xpert Find will allow Tradesman to purchase only current Job leads which the Customer has not closed, amended or cancelled at the time of the purchase. However, as Customers may choose to amend or cancel their Job at their own discretion Xpert Find does not make any warranty whatsoever of the continued availability of the Job lead.

Xpert Find makes no guarantee to refer any Jobs to a Tradesman. You must ensure that you are both legally able to tender for a Job and that you are legally able to perform the Work specified in the Job description.

Indemnity

You agree to indemnify and hold Xpert Find and (as applicable) our directors, agents, and employees harmless against any and all expenses, damages and losses of any kind (including reasonable legal fees and costs) incurred by Xpert Find in connection with any claims, actual or threatened, of any kind (including without limitation any claim of trademark or copyright infringement, libel, defamation, breach of confidentiality, false or misleading advertising or sales practices) arising from the provision of your information or from your use of the Website

Disputes

Should Users have a dispute with another User or any third party, they must, in the first instance, address such dispute directly to the User concerned. Although Xpert Find will gratefully receive feedback regarding your experience, You understand and agree that Xpert Find is under no obligation to become involved. Furthermore, you hereby release Xpert Find, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and/or our service.

Xpert Find may at its sole discretion without being under legal obligation to do so, investigate any grievances held by Users, and may discuss any investigation with all involved parties. As a result of this investigation a User may be banned indefinitely from using the services of Xpert Find.

Website Usage

You agree to use the Website lawfully in a manner such that you do not disrupt services to other Users or internet users. You agree not to use the Website to distribute by any means computer viruses or worms to Users or Third Parties.

You understand that all material, not limited to postings, messages, text, files, images, photos, video, sounds, or other materials posted on, transmitted through, or linked from Xpert Find are the sole responsibility of the User from whom such content originated and as such You agree to provide true, accurate, current and complete information when providing details to Xpert Find.

You understand that Xpert Find does not control the information provided by other Users, which is made available through the Website. Furthermore, that Xpert Find makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any independent websites that are linked to the Xpert Find website

You acknowledge that Xpert Find does not pre-screen or approve all content, but that we shall have the right (but not the obligation) in our sole discretion to refuse, delete or move any content that is available on the Website for violating the letter or spirit of the terms or for any other reason.

As a Tradesman, you will receive contact information for Customers whom you have expressed an interest in working for, on a Job. You agree to only use this contact information for Xpert Find-related communications that relate to your genuine participation in the Website.

Feedback

Xpert Find will ask Customers for feedback evaluations (including ratings) relating to Tradesmen regarding Customer Jobs. You agree that this feedback is the sole content of Xpert Find, and as such, can be published in part or full, on the Website. You hereby agree that Xpert Find is not responsible for the feedback content that Customers post, or any harm done by such feedback content.

The Customer who posts the feedback is directly responsible for his or her written evaluation. In some exceptional circumstances, we may remove feedback, but only at our sole discretion.

All Users understand that any abuse (such as, but not limited to, profanity or derogatory pictographic content) of the feedback function or any other part of the website may be banned from further use and reported to the authorities, if applicable. We do perform a number of checks on feedback to ensure authenticity and may at our sole discretion remove any feedback that we cannot verify.

Our Intellectual Property

Xpert Find owns all the intellectual property rights relating to the site, including the designs, text, database, graphics and layouts, and you agree not use or copy any part thereof without our express permission.

By uploading any information and material to the Website, you are giving express and irrevocable permission for us to store, display and use the content.

Website and Service Limitations

You acknowledge that Xpert Find has no responsibility or liability for the deletion or truncation of any content or failure to store any content maintained or transmitted by the Website. You agree that Xpert Find, in its sole discretion, reserves the right to suspend or discontinue its service to individual Users, immediately and without notice, and remove and discard any content within the website, for any reason, including, without limitation, if Xpert Find believes that you have acted inconsistently with the letter or spirit of the terms.

Further, you agree that Xpert Find shall not be liable to you or any third-party for any termination or restriction of your access to the website.

Changes

Xpert Find reserves the right to change or update these terms and conditions from time to time and shall post such alterations in relevant sections on the website. As a User of the website, you are responsible for acknowledging any updates of these terms and conditions by visiting this section.

Xpert Find reserves the right to modify or discontinue all or part of, temporarily or permanently, the Website with or without notice to you and you confirm that Xpert Find shall not be liable to you or any Third Party for any modification to or discontinuance of the Website.
